Building regulations

As a matter of course Building Regulations should be assumed to apply to any structure requiring Planning Permission. Most ground level domestic decks are unlikely to require planning permission however limitations in England may apply which limit the overall permitted surface of decking to no more than 50% of the total garden area.

With the exception of ground level decks it is advisable to check that planning regulations do not apply to a proposed structure and ideally neighbours who may be affected should be informed.

Situations where planning is required include:

  • Where the deck is situated within 20 metres from a highway
  • Where the deck platform is more than 300mm from the ground
  • If the structure would affect the amenity value or privacy of neighbouring properties
  • If the deck is attached to a listed building or situated in a National Park or Conservation Area
